The primary responsibility for providing information about food is the food business operator under whose name or company the food is marketed, or if the operator is not established in the EU the importer. According to Article 8 Paragraph 3 of the Food and Drug Administration Regulation, food business operators at other distribution levels are also secondarily responsible, as they are not permitted to market food that does not meet the requirements of the Food and Drug Administration Regulation.
